Welcome to My Travel Geeks. These Terms & Conditions (“Terms”) govern your use of our website, booking platform, services, and vehicles (collectively, the “Services”) provided by My Travel Geeks (hereinafter referred to as “we”, “us”, “our”, or “My Travel Geeks”). By accessing or using our Services, you agree to these Terms. If you do not agree with any part of these Terms, you must not use our Services.
1. Use of Services
1.1 You may use our Services only if you are at least 18 years old and legally capable of entering into a contract.
1.2 You agree to provide accurate, current and complete information when you register or make a booking.
1.3 You must comply with all applicable laws and regulations while using our Services.
2. Booking, Cancellation & Payment
2.1 Bookings: All bookings of cars, cabs or chauffeur-driven vehicles are subject to availability, confirmation by us, and these Terms.
2.2 Payments: You agree to pay all fees and charges for Services in accordance with the payment terms presented at time of booking. We reserve the right to change pricing or payment methods at any time.
2.3 Cancellation & Amendments: You may cancel or amend a booking in accordance with our policy as displayed at the time of booking. We may cancel or amend a booking due to circumstances beyond our control (including driver or vehicle unavailability, force majeure, regulatory changes).
2.4 Refunds: If a refund is applicable, it will be processed as per our refund policy, subject to deductions (if any) for costs incurred.
3. Vehicles, Drivers & Conduct
3.1 We strive to ensure that all vehicles provided are properly licenced, insured, well-maintained and that drivers are professionally qualified, trained and comply with applicable laws.
3.2 You must comply with the driver’s instructions and the local traffic laws at all times.
3.3 The vehicle must be returned in the same condition as received, subject to fair wear and tear. You may be held responsible for damage, cleaning or repairs resulting from misuse.
3.4 Prohibited conduct: You must not use our Services for any illegal purpose, excessive traffic violation risk, reckless driving, harmful or offensive behaviour, or in breach of any applicable law.
4. Liability and Indemnity
4.1 We provide our Services on an “as-is” and “as available” basis, and to the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose, merchantability, and non-infringement.
4.2 To the maximum extent permitted by law, My Travel Geeks shall not be liable for any indirect, incidental, special, punitive or consequential damages (including lost profits, loss of business, theft, delay or damage to property) arising from your use of the Services or inability to use them.
4.3 You agree to indemnify, defend and hold harmless My Travel Geeks, its directors, officers, employees, agents and suppliers, from and against any and all claims, liabilities, damages, losses or expenses (including legal fees) arising out of your misuse of the Services or breach of these Terms.
5. Intellectual Property
5.1 All trademarks, logos, service marks, text, graphics, images, audio and video clips on the Sites and Services are owned by My Travel Geeks or its licensors and are protected by intellectual property laws.
5.2 You are granted a limited, revocable, non-exclusive licence to access and use the Services for your personal, non-commercial use only. Any other use is prohibited without our prior written consent.
6. Privacy
Our collection and use of your personal information is described in our Privacy Policy. By using the Services, you consent to the collection and use of your information in accordance with that policy.
7. Changes to Terms
We may modify or replace these Terms at any time by posting the updated version on our website. The “Last updated” date will be revised accordingly. Your continued use of the Services after such changes constitute your acceptance of the new Terms.
8. Governing Law & Dispute Resolution
8.1 These Terms and any dispute or claim arising out of or in connection with them or our Services shall be governed by and construed in accordance with the laws of India (specifically Indian Contract Act, 1872 and other applicable statutes).
8.2 Any dispute shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
8.3 Prior to initiating legal proceedings, the parties shall attempt in good faith to resolve the dispute amicably through negotiation or mediation.
9. Miscellaneous
9.1 If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
9.2 Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
9.3 These Terms, together with our Privacy Policy and any other policies we post, constitute the entire agreement between you and My Travel Geeks regarding your use of the Services.
